Terms of Use

The portal ("PORTAL") is a service provided by CAI GmbH ("CAI"), Erbprinzenstraße 4–12, D-76133 Karlsruhe, Germany.

The use of the PORTAL is only possible if you, as the user, expressly agree to these Terms of Use.

1. Scope of application of these Terms of Use

These Terms of Use apply to all persons (“Users”) who use the PORTAL. They apply regardless of whether the User

  1. has personally entered into a contract with CAI, or
  2. is acting on behalf of a company that has entered into a contract with CAI, or
  3. was invited by another User (1.a or 1.b) but has not entered into a contract with CAI.

2. Obligations of the Users

  1. A personal access (account) will be set up for each User. Each User assigns themselves a password. The User is responsible for ensuring that the password is not accessible to any third party. Any disclosure to third parties is prohibited. The User assumes full responsibility for all actions taken using their login name in connection with their password.
  2. The User undertakes to notify CAI immediately in writing of any abusive use of their login name / registration as soon as they become aware of it. In the event of abusive use, the User undertakes to change their password immediately.
  3. The use of trademark-protected words and internet addresses as the User's name (nickname) is not permitted.
  4. The User undertakes not to post any content that violates these rules, public morality, or otherwise violates applicable German law. In particular, it is prohibited to:
    1. use the PORTAL abusively;
    2. use, promote, offer, or distribute pornographic, violence-glorifying, abusive, immoral content or content that violates youth protection laws;
    3. unreasonably harass other Users;
    4. publish insulting or untrue content;
    5. send spam via the system to other Users;
    6. use content protected by law, in particular by copyright and trademark law, without authorization;
    7. engage in anti-competitive actions;
    8. publish third-party copyright-protected content (e.g., documents) without the consent of the author;
    9. engage in advertising without the express written permission of CAI.
  5. Should third parties or other Users hold CAI liable for possible legal violations that
               a. result from content posted by the User and/or
               b. arise from the use of the PORTAL by the User,
    the User undertakes to indemnify CAI against any claims, including damage claims, and to reimburse CAI for the costs incurred due to the possible legal violation. In particular, CAI shall be indemnified against the costs of necessary legal defense. CAI is entitled to demand a reasonable advance payment from the User for this purpose. The User is obliged to support CAI in good faith with information and documents in the legal defense against third parties. All further rights as well as damage claims by CAI remain unaffected. If the User is not responsible for the possible legal violation, the aforementioned obligations do not apply.
  6. Users are bound by the strictest confidentiality regarding the personal data of other Users. Any disclosure of data to third parties without the prior written consent of the person concerned is prohibited.
  7. The technical requirements for using the PORTAL are described on the website https://www.cai-world.com/systemvoraussetzungen. It is the User's responsibility to ensure that they meet the technical requirements. All data plans for internet use (e.g., from the mobile service provider or network operator used) as well as all other fees and taxes associated with the use of our services are the responsibility of the User.
  8. The User is specifically not authorized to "reverse engineer", decompile, disassemble, reproduce, or use any part of the PORTAL to create a separate application or software. Accessing functions and databases outside of the provided user interfaces and interfaces (e.g., with the help of third-party software) is prohibited.

3. Obligations and Rights of CAI

  1. If CAI has concrete evidence that a third party is using the User's access without authorization, or that use is violating these Terms of Use, CAI is entitled to block access until the matter is clarified.
  2. In the event of a violation, particularly of the aforementioned rules, CAI may, regardless of a termination or blocking of access, also impose the following sanctions against the User:
               a. Deletion or blocking / hiding of documents and posts that the User has posted,
               b. Issuing a formal warning.
  3. CAI is also entitled to block the User's access to the PORTAL if there is a reasonable suspicion that the User has violated these Terms of Use. The User can avert these measures if they dispel the suspicion by providing suitable evidence at their own expense.
